Terms of Service

These terms govern your use of cloudmountaingraphics.com and your purchase of design and development services from Cloud Mountain Graphics Ltd. (“CMG,” “we,” “us”). By using the site, creating an account, or purchasing a package, you agree to these terms.
1. Services
CMG provides design and development services including web design, brand identity, print and collateral design, and custom software development. Fixed-price packages are described on our Shop page; each package lists exactly what it includes, its price, and the number of revision rounds. Work outside a package’s listed scope is quoted separately before we do it.
2. Payment
Payments are processed by Stripe. We never see or store your card details. Packages may be paid in full at purchase, or — for projects of $1,500 or more — started with a 50% deposit, with the remaining balance due at final delivery. Where buy-now-pay-later options (such as Klarna, Afterpay, or Affirm) appear at checkout, your agreement for that financing is with the provider, not with CMG.
Final files and deliverables are released upon payment in full.
3. Your account and client portal
Purchasing a package creates a client account so you can follow your project in the client portal — milestones, file sharing, deliverable review, and messaging. You are responsible for keeping your login credentials secure and for the accuracy of information you provide. The portal is for project collaboration; do not use it to transmit unlawful content or content you do not have rights to.
4. Client materials
You retain ownership of everything you provide to us (logos, photos, copy, brand assets), and you confirm you have the right to use and share those materials. You grant us permission to use them solely to perform the work you hired us for.
5. Ownership of the work
Once your project is paid in full, you own the final deliverables — designs, files, and code created for you — including source files. Until full payment, deliverables remain CMG property and are provided for review only.
We retain the right to display completed work in our portfolio and marketing unless you ask us in writing not to. Preliminary concepts that you did not select remain CMG property.
6. Revisions and approvals
Each package includes the revision rounds listed in its description. Additional rounds or scope changes are available and quoted before work begins. When you approve a deliverable in the portal (or in writing), that stage is considered accepted.
7. Timelines
Project schedules depend on both of us. We work promptly once a project starts; delays in providing materials, feedback, or approvals extend the schedule accordingly. Estimated timelines are good-faith estimates, not guarantees.
8. Cancellation and refunds
Cancellation and refund treatment is described in our Refund Policy, which is part of these terms.
9. Warranties and liability
We warrant that our work is original to us (excluding materials you supply and properly licensed third-party assets, such as fonts or stock imagery, which are subject to their own licenses). Otherwise, services are provided “as is.” To the fullest extent permitted by law, CMG’s total liability for any claim arising out of a project is limited to the amount you paid for that project, and we are not liable for indirect or consequential damages such as lost profits.
You are responsible for the legal compliance of your own business and content — for example, ensuring text you approve is accurate and that your use of the deliverables complies with laws that apply to your industry.
10. Third-party services
Websites and applications we build may rely on third-party services (hosting, domains, payment processors, email providers). Fees and terms for those services are between you and the provider unless a package explicitly states otherwise.
11. General
These terms are governed by the laws of the State of Colorado. If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms from time to time; the version posted on this page applies, and material changes will be dated above. Continued use of the site or services after a change constitutes acceptance.
